DMCA Copyright Infringement Policy

Effective Date: 1/1/2025

Adaptive Web Hosting ("Adaptive", "we", "us", or "our") complies fully with the Digital Millennium Copyright Act of 1998 (DMCA) and expects its customers to do the same. We take copyright violations seriously and respond promptly to clear notices of alleged infringement that comply with the DMCA.

This policy outlines how copyright holders may submit DMCA takedown notices, how customers may file counter-notifications, and how Adaptive handles copyright complaints.

1. DMCA Notice (Takedown Request)

If you are a copyright holder (or represent one), and you believe that content hosted by Adaptive Web Hosting infringes your copyright, you must submit a formal DMCA takedown notice including the following:

Required Information:

Identification of the copyrighted work claimed to be infringed.

Identification of the infringing material, including the exact URL(s) where the content is located on our customer’s website, sufficient to enable us to locate the content.

Your full legal name, mailing address, telephone number, and a valid email address.

Two statements, signed and dated (a scanned or electronically signed PDF is acceptable):

"I have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."

"I declare, under penalty of perjury, that the information in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

A physical or electronic signature of the copyright owner or an authorized agent.

Important:

Knowingly submitting false or misleading claims under the DMCA may subject you to civil damages, court costs, and attorney's fees, and in some cases criminal penalties.

Once a valid DMCA notice is received:

We will promptly notify the affected customer.

If the content is not voluntarily removed, we may disable access to the material in accordance with DMCA obligations.

We will preserve logs of the communication in the event of further legal action.

2. DMCA Counter-Notification (Response to Takedown)

If you are a customer of Adaptive and you believe that content was wrongly removed or disabled as a result of a DMCA takedown notice, you may file a counter-notification under the DMCA.

Required Information:

A clear description of the content that was removed or disabled and the URL where it previously appeared.

Your full legal name, mailing address, telephone number, and email address.

Two statements, signed and dated (a scanned or electronic PDF is acceptable):

"I have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material."

"I consent to the jurisdiction of the Federal District Court in the judicial district of my address. If outside the United States, I consent to jurisdiction in any U.S. judicial district in which the service provider may be found, and I will accept service of process from the person who provided the original DMCA notice or their agent."

Your physical or electronic signature.

Once a valid counter-notification is received:

We will forward it to the original complainant.

If the complainant does not initiate a legal action within 10 business days, we may restore the material at our discretion.

3. Submitting a DMCA Notice or Counter-Notification

All DMCA notices and counter-notices must be submitted to:

We accept electronic submissions only. Do not send postal or faxed documents.

❗ Non-DMCA inquiries sent to this address will be discarded without response.

4. Repeat Infringer Policy

Adaptive maintains a zero-tolerance policy toward repeated copyright violations. If a customer is found to be a repeat infringer, their account and services may be terminated without notice and without refund.
