Domain Name Registration Agreement
Effective Date: 1/1/2025
This Domain Name Registration Agreement ("Agreement") is a legally binding contract between you ("Registrant," "you," or "your") and Adaptive Web Hosting ("Adaptive," "we," "us," or "our"). By registering, transferring, or managing a domain name through Adaptive, you agree to be bound by this Agreement.
This Agreement is an integral part of the Adaptive Terms of Service (TOS) and incorporates the applicable Registrant Agreement of our Registrar partners, including ResellerClub, eNom, and others, as well as ICANN’s Uniform Domain Name Dispute Resolution Policy (UDRP).
You must also comply with:
ICANN Registrant Rights and Responsibilities
ICANN UDRP
ResellerClub Domain Registration Agreement
Domains not registered through Adaptive are not our responsibility, even if hosted with us.
1. Domain Name Registration & Management
1.1 Submitting a domain order does not guarantee successful registration. The domain is only registered upon confirmation.
1.2 All registrations are subject to the policies of the relevant registry, registrar, and ICANN. Adaptive is not liable for rejected or suspended domain applications.
1.3 Domains registered or transferred through Adaptive can be managed via your control panel.
1.4 Domain purchases and renewals are non-refundable. Renewal pricing and periods may vary by TLD and registry policies.
2. Registrant Information
2.1 You must provide accurate and complete contact information. This includes your name, email address, and other relevant data as required by the registrar and registry.
2.2 If you register a domain for a third party, you must have their prior consent to submit their information.
2.3 Some registries require verification of contact data before completing or updating a domain registration. Failure to verify in a timely manner may result in suspension or deletion.
2.4 You are solely responsible for ensuring your information remains up to date. Inaccurate data or failure to respond to inquiries may result in suspension or cancellation of the domain.
3. Use & Disclosure of Registration Data
3.1 You consent to the use and disclosure of your registration data as required by the registrar, registry, ICANN, and applicable law.
3.2 WHOIS data may be published in accordance with registry or ICANN policies. Adaptive does not guarantee privacy unless privacy protection services are purchased.
3.3 You waive any claims against Adaptive for disclosures made in compliance with applicable regulations.
4. Domain Transfers
4.1 You may initiate a registrar transfer only if you are the listed domain registrant or authorized agent.
4.2 Additional documentation may be required to verify your authority or ownership during a transfer.
4.3 Upon a successful transfer, Adaptive’s registrar partner becomes the registrar of record.
4.4 Transfers are governed by the applicable registry and registrar rules. Adaptive is not liable for failed transfers due to ineligibility or policy restrictions.
5. WHOIS Privacy / ID Protect
5.1 WHOIS Privacy (ID Protect) is available for supported TLDs. This service masks your public contact details.
5.2 If using WHOIS Privacy:
You must maintain accurate internal contact info.
You may not use privacy to conceal illegal or abusive activity.
You must respond promptly to forwarded legal or abuse notices.
5.3 WHOIS Privacy is provided by our registrar partners. Adaptive is not liable for accidental disclosures.
6. Disputes and Legal Proceedings
6.1 Adaptive is not a party to domain ownership disputes. You are solely responsible for managing and defending your rights.
6.2 We may suspend or lock a domain under legal threat or formal dispute (e.g., UDRP) at our discretion.
6.3 All domain disputes are governed by ICANN’s UDRP.
7. Free Domain Name Promotions
7.1 Domains offered as part of a free hosting promotion become billable if hosting is canceled within the first year. The domain cost will be invoiced at regular rates.
7.2 Domains are subject to ICANN’s 60-day transfer lock from registration or transfer.
7.3 You retain ownership upon renewal, and may transfer the domain after the lock period expires.
8. Termination and Suspension
8.1 We may suspend or cancel domain services if you:
Provide false or outdated contact info
Violate ICANN, registrar, or registry policies
Engage in illegal or abusive use of the domain
Breach this Agreement or our TOS
8.2 Suspension may lead to loss of website access, email, DNS, and other services tied to the domain. Adaptive is not liable for resulting damages.
9. Changes to this Agreement
Adaptive reserves the right to amend this Agreement at any time. Updates will be posted on our website. Continued use of our domain services after changes go into effect constitutes your acceptance of the revised terms.
